Mark Wilde has been cited by the UK Supreme Court
Mark Wilde has been cited by the UK Supreme Court in the case of Coventry and others (Respondents) v Lawrence and another (Appellants) [2014] UKSC 13. The cases raises several fundamental issues regarding the tort of private nuisance and is set to become a textbook standard authority. One of the issues concerned the equitable discretion to award damages in lieu of an injunction. The Court ruled that a more flexible approach to the use of the discretion should be adopted; this is something which mark argued for in his article ‘Damages in lieu of an injunction – challenging the orthodoxy of the Shelfer criteria’ (2013) and this was cited by Lord Carnwath at paras 244 and 247.
